Two PA Pedestrians Killed in Corolla, NC

By James Lewis, North Carolina Personal Injury Attorney

This week, two people on vacation from Pennsylvania were walking along NC 12 in Corolla, when they were hit by an SUV that ran off the highway. Both pedestrians were killed in the wreck.

The incident occurred in the 700 block of Ocean Trail, close to a water plant that is south of the Monteray Shores and the Tim Buck II shopping centers. It happened at 11:30 AM, according to the North Carolina state police.

The media reported that an 2008 Honda CRV was driving north on NC 12 when the SUV ran off the road onto the shoulder and slammed into the pedestrians. They were walking on the right side of the road with their backs to oncoming traffic.

The state police stated that both victims died on scene.

According to the police, a man from Ashburn, VA was charged with careless and reckless driving, and also two counts of misdemeanor death by motor vehicle. It is believed that the driver fell asleep behind the wheel.

A newspaper in Virginia identified the deceased couple as Wesley and Elizabeth Martin, from Lancaster PA. They were walking on a path that goes parallel to NC 12. The couple was on vacation with their four children, who were on the beach with other members of their family.

It is not clear at this time if the family of the deceased is going to file a lawsuit against the accused. However, in most states, in a wrongful death law suit, the victims’ family is usually entitled to several types of damages, including for:

·         Sorrow, mental anguish and loss of solace

·         Expected loss of income

·         Loss of services, protection, care and assistance to beneficiaries

·         Expenses for the care, treatment and hospitalization of the deceased

·         Funeral expenses

The law in most states allows the victims’ family to recover substantial compensation in a civil law suit. It is worth considering this option by consulting with an experienced personal injury lawyer in your state.
