Kinston Man Attacked By Ferocious Pit Bulls Feared For His Life

A Kinston, North Carolina (NC) man is recuperating only days after he was attacked my two menacing Pit Bulls that were apparently on the loose in his neighborhood. The victim, L.H. Clemmons, has reported that the attack happened last week when he was taking trash to his truck.

It seems that al most any day of the week that someone has been attacked by a Pit Bull. Unfortunately, this is an all too common mishap that often occurs with serious and critical bite wounds and sometimes death, especially among younger, defenseless children.

An owner of an attacking dog is usually held responsible for the crime of “Reckless Endangerment”. When a person commits the crime of reckless endangerment the person recklessly engages in conduct which creates a substantial risk of serious physical injury to another person. “Reckless” conduct is conduct that exhibits a culpable disregard of foreseeable consequences to others from the act or omission involved.

The accused need not intentionally cause a resulting harm or know that his conduct is substantially certain to cause that result. The ultimate question is whether, under all the circumstances, the accuser’s conduct was of that heedless nature that made it actually or imminently dangerous to the rights or safety of others. This crime can range from a misdemeanor to a felony.

Although Pit Bulls as a breed get a bad rap, they are one of a certain group of dogs that have a propensity of aggression if taught to fight or mistreated and uncared for. Essentially, a dog with this demeanor is acting as a dangerous weapon that could inflict significant harm if unrestrained by their owners. This is exactly what happened to Mr. Clemmons.

The attacking Pit Bull is a neighbor’s dog. It lunged at Clemmons and clawed at the man’s face as he ran towards his home fearing for his life. The dog that is believed to be responsible for the attack is now in custody with the S.P.C.A.
