A 27 year old man died in an Oct. 7 van crash on I-495 in Knightdale NC when the van he was riding in ran off the highway, crashed and overturned.

At approximately 1:30 AM, a 25 year old male was driving a 2004 Ford passenger van on I-495 when he fell asleep behind the wheel. The van ran off the road to the right at high speed. The driver overcorrected and it ran off the road to the left, went up an embankment and flipped.

The passenger died at the scene. The driver and two other occupants were taken to a local hospital for treatment of minor injuries.

The driver has been charged with misdemeanor death by motor vehicle and driving while license revoked.

Our View

It is well known that fatigued driving causes many car accidents. A study by the Virginia Tech Transportation Institute found that fatigue causes as many as 20% of all car accidents.

Given that the driver has been charged, it is likely that a wrongful death lawsuit against him could be successful. Any money recovered from insurance companies in this tragic accident could provide comfort to the family and would replace the young man’s lost wages that he would have earned if he had lived a full life.
