Two people were killed in a two-vehicle crash in Logan County, West Virginia on April 18, according to the West Virginia State Police. The crash happened at 4 pm on US 119 and Old Logan Road.

The state police reported the driver and passenger in an SUV hit a pickup truck at the intersection. A third passenger in the SUV was hurt and taken to the hospital. The pickup truck driver did not suffer serious injuries.

The West Virginia State Police stated the SUV turned onto US 119 from Old Logan Road when the pickup truck hit it. It is believed the pickup truck had right of way, but the accident investigation is still underway.

Our View

In our years of experience as car accident personal injury attorneys, we know that failure to yield right of way is one of the most common causes of car accidents. A failure to yield happens when the driver does not yield the road to another driver, leading to a crash. These types of accidents commonly happen when there is a flashing red or yellor light, when a driver makes a left turn and does not yield to oncoming traffic, or when an aggressive driver merges onto a highway and does not yield properly.

Failure to yield is a common reason that people are injured and killed in car accidents, and if the other driver is hurt, he or she can sue for compensatory damages. Damages that can be obtained in a lawsuit can be noneconomic and economic, and may include medical bills, out of pocket costs, household services, disfigurement, rehabilitation and pain and suffering.

In the above accident, it may have been the SUV driver who was at fault, according to what has been reported so far. If so, the injured passenger in the SUV may be able to file a lawsuit on the insurance policy of the deceased driver. Also, the pickup truck driver could file a lawsuit as well on that policy if he suffered any injuries.

Our Virginia car accident lawyers handled a $1 million settlement where the defendant entered Virginia Beach Blvd. in Virginia Beach and failed to yield right of way to our client who was driving east on that road. The violent collision led to serious orthopedic injuries for our client, and she had to be removed from the car by first responders.

Failure to yield can cause very serious accidents, and it would behoove all drivers to always be sure to yield if required to do so.
